Windows Vista™ Sidebar Gadget Competition
 
  
1.         Instructions on how to enter form part of the conditions of entry. By participating entrants agree to be bound by these conditions.
 
2.         The promoter is Microsoft Pty Limited, ACN 002 589 460 of 1 Epping Road, North Ryde, New South Wales, 2113.
 
3.         Entry is open to Queensland residents.  Employees and their immediate families of the promoter, its retailers, suppliers and associated companies and agencies are not eligible to enter.
 
4.         The promoter reserves the right to verify the validity of entries and to disqualify any entrant who the promoter believes either has tampered with the entry process or has submitted an entry that is not in accordance with these conditions of entry.
 
5.         The competition commences at 9:00am (Sydney time) on 23rd March 2007 and closes at 5:00pm (Sydney time) on 29th June 2007.  Entrants can have a maximum of three entries.
 
6.         To enter, participants must:
 
a.    develop a functional Windows Vista™ Sidebar Gadget with a Queensland theme and load it to http://gallery.live.com;
b.    provide a brief description of what the gadget does and how it is architected, 
c.    tag the gadget with ‘Australia’, ‘Queensland’ and ‘Vistacomp’; and
d.    go to http://www.innovationqld.net/VistaGadgets/Pages/Registration.aspx to register for the competition. 
 
7.         All entrants acknowledge and agree that loading of their entry on the Live Gallery site will enable the public to download and use their entries.  If an entrant does not want the general public to have access to their entry, they should not enter the competition.  
 
8.         All valid entries received by the closing date will be reviewed by the judging panel.  This is a game of skill and chance plays no part in determining the winners.  Each entry will be individually judged based on compliance with the competition Queensland theme, innovation, originality and creativity.
 
9.         The following prizes will be awarded:
 
a.    the best entry judged will win an Xbox 360™ Premium Pack (containing an Xbox 360 video game and entertainment console with premium chrome finish, Xbox 360 Wireless Controller, Xbox 360 20 Gb Hard-Drive, Xbox 360 Component HD AV Cable, Xbox 360 Media Remote and Ethernet Cable) valued at $600 (including GST).
b.    the second best entry judged will receive a Microsoft® Lifecam VX-6000 valued at $149.95 (including GST); and
c.    the third best entry judged will receive a Microsoft® Wireless Notebook presenter mouse 8000 valued at $149.95 (including GST);
d.    the fourth best entry judged will receive a Microsoft® 2GB USB Pen valued at $120 (including GST).
e.    In addition, the 50 best entries judged will each receive an Xbox 360™ cap valued at $10 (including GST).
 
10.      Total number prizes = 54.  Total prize value = $1520.  Prizes are not exchangeable, transferable or redeemable for cash.  If the promoter is unable to supply a nominated prize, the promoter reserves the right to supply another prize of greater or equal value.
 
11.      All entries become the property of the promoter.  The promoter’s decision is final and no correspondence will be entered into.  No responsibility is accepted for entries not received by the promoter. Entries will be deemed void if stolen, forged, mutilated or tampered with in any way.
 
12.      By submitting an entry, each entrant grants to the promoter a non-exclusive, irrevocable royalty-free, transferable worldwide right, in all media (now known or later developed) to use, publish, alter or otherwise exploit the subject matter of their entry.  Each entrant forever releases the promoter from any and all claims the entrant may have in connection with the use and exhibit of their entry as set out above.  Each entrant also agrees to sign (or have their parent or legal guardian sign if you the entrant is under the age of 18) any necessary documentation to effectuate that license and release.  If an entrant does not want to grant the promoter the foregoing, they should not enter the competition.  The promoter is not obligated to use any entry. Each entrant waives any claim of infringement (including without limitation copyright, trademark, patent, trade name, trade secret, etc.) against the promoter or its licensees based upon access to or use of an entrant’s entry. In the event of any dispute regarding who is the entrant that submitted an entry, the potential winner must provide the promoter with proof that the potential winner is the authorised account holder of the e-mail address associated with the potentially winning entry.
 
13.      All entries are deemed to be received at the time of receipt into the competition database and not at the time of transmission by the entrant. 
 
14.      The stated prize value is the recommended retail value (including GST) in Australia as provided by the supplier and is correct at the time of printing. The promoter accepts no responsibility for any variation in the value of the prize. The promoter and its associated agencies and companies accept no responsibility for prizes damaged or lost in transit.
 
15.      Winners of all prizes will be notified via email on or about 13 July 2007.   
 
16.      In the event that a prize is not claimed the judges will select an alternate winner to receive the prize.
 
17.      If a winner of the prize is under the age of 18 years, the prize will be awarded to the winner subject to the prior written consent of the winner’s parent or legal guardian. The Promoter may make such inquiries as it deems necessary to satisfy itself that such consent has been obtained.
 
18.      Subject to any applicable law which cannot be excluded, the promoter and its related bodies corporate shall not be liable for any loss, damage or injury suffered or sustained (including but not limited to direct or consequential loss or loss arising from negligence) arising directly or indirectly out of or in connection with the competition or any prize.
 
19.      Any costs associated with entering the competition and accessing the website are the responsibility of the entrant.
 
20.      The promoter assumes no responsibility for, and the entrant releases the promoter from responsibility for, any failure to receive an entry or for inaccurate information or for any loss, claim, damage or injury to person or property (including computer systems and servers) as a result of the entrant’s participation in this competition or the conduct of the competition generally or as a direct or indirect result of an entrant’s error, any technical problem of any kind including communications or network failure, unauthorised access to, transferring or theft of data, whether caused by the entrant or associated with the equipment or programming used in the conduct of this competition.  If, because of any such problem, this competition is not able to be conducted as planned and/or the competition’s administration, security, fairness or integrity are compromised or affected, the promoter may cancel, terminate, modify or suspend the competition and/or disqualify any entrant involved in interfering or tampering with the conduct of this competition in any way.
 
21.      Details from all entries will be collected and used for the purposes of conducting this competition (which may include disclosure to third parties for the purpose of processing and conducting the competition) and for publicity purposes surrounding this competition.  By entering this competition entrants consent to the use of their information as described.  Entrants may access and/or change their data by following the procedures in the promoter’s privacy policy which is available at www.microsoft.com/australia/privacy.  The promoter will only use your personal details for marketing purposes outside those described above if you “opt in” to join the mailing list when prompted.
